Terms and Conditions for Short-Term Rental
General
1.1. These Terms and Conditions govern the rental agreement between [Jarred Smith] (“Host”) and the guest (“Guest”) for the short-term rental of properties listed on the Muizenberg Short Stays website (“Properties”).
1.2. By booking the Property, the Guest agrees to these Terms and Conditions.
Booking and Payment
2.1. The booking is confirmed upon receipt of the required deposit.
2.2. Payment methods accepted are debit and credit cards in South African Rand (ZAR).
2.3. A booking deposit of 50% is required to secure the reservation dates, and the remaining booking fee is due atleast 5 days before arrival. For bookings made within 5 days of the arrival date, full payment is required at the time of booking to secure the reservation.
2.4. Should the balance of the booking fee not be paid in accordance with 2.3, the booking deposit becomes non-refundable.
Cancellation Policy
3.1. Guests can cancel the booking up to 5 days before check-in for a full refund.
3.2. No refunds will be given for early departures or no-shows.
Check-In and Check-Out
4.1. Check-in time is from 14:00 on the arrival date.
4.2. Check-out time is by 10:00 on the departure date.
4.3. Early check-in and/or late check-out is subject to availability and may incur additional charges.
Occupancy and Use
5.1. The maximum occupancy of the Property is 2 guests.
5.2. The Property is for residential use only. No commercial activities are allowed.
5.3. Parties, events, and gatherings are not permitted without prior written consent from the Host.
House and Additional Rules
6.1. Guests must adhere to the following house rules:
- No smoking inside the Property.
- No pets allowed unfortunately.
- Keep noise to a minimum between 22:00 and 08:00.
- Respect neighbours, community, and any specific rules applicable to the Property.
Maintenance and Damages
7.1. Guests are responsible for maintaining the Property in good condition.
7.2. Any damages or issues must be reported to the Host immediately.
7.3. Guests will be charged for any damages caused during their stay.
Liability
8.1. The Host is not liable for any accidents, injuries, or illnesses that occur while on the Property.
8.2. The Host is not responsible for the loss of personal belongings or valuables of the Guest.
Termination
9.1. The Host reserves the right to terminate the rental agreement without notice if the Guest violates any of these Terms and Conditions.
9.2. In the event of termination, the Guest must vacate the Property immediately, and no refunds will be issued.
Governing Law
10.1. These Terms and Conditions are governed by and construed in accordance with the laws of South Africa.
10.2. Any disputes arising from these Terms and Conditions shall be resolved in the courts of Cape Town, South Africa.
Agreement
By making a booking, the Guest agrees to comply with these Terms and Conditions.
